[AskAVet] Selling a horse being made illegal?

I am writing you this email as a last ditch effort to warn horse owners that if Assembly Bill 1122 in the California legislature passes, it will have a debilitating effect on the sales of all horse breeds in California.  While AB 1122 says it will be a crime to sell an animal on a public street, if you read the wording of the bill it becomes apparent this bill will make it an act of animal cruelty to sell a horse at most horse shows.  I represent an organization called PetPAC. We are a political organization representing over 65,000 pet owners and 1,900 dog and cat clubs. You can check us out at www.petpac.net. I have been a legislative advocate for over 25 years during which I represented law enforcement.  I have attached a copy of AB 1122 for your perusal.

 

During this legislative session I have written to 4H clubs, the fishing industry and most agriculture groups and in so doing they agreed with my assessment and were able to get themselves amended out of the bill.  I have notified horse groups to no avail. 

 

According to the bill there is an exception if your horse is "on consignment" at a horse sale.  But if you advertise, display or offer for sale a horse on a public right of way you can be charged with animal cruelty.  Please pay attention to this.  Horse shows for the most part are held at county fairgrounds and public arenas.  At horse shows there are always a few horses for sale.  Roads within county fairgrounds  are all public right of ways.  This would make displaying for sale or selling illegal under AB 1122.

 

Just the act of offering for sale or selling an animal under these conditions would be a violation of California animal cruelty laws.  This is regardless of the condition of the animal.  A conviction of animal cruelty under this law would allow the courts to seize all of your animals. (California Penal Code Section 597.1).

I would ask that you send this email out to your California members so they may decide what action they might want to take.  In the least they need to contact their California state senator to voice their concern over this bill.  Most dog and cat clubs already oppose AB 1122. The California Department of Finance has come out opposed to AB 1122. AB 1122 is supported by HSUS, the Humane Society of the United States and other animal rights groups.  AB 1122 is waiting a vote on the Senate Floor. That vote will come next week. It then goes to the Governor who has 30 days to sign the bill or veto it.  I would urge you to look at AB 1122 and read it carefully. I think you will agree with me and the thousands of dog and cat owners who oppose it.

 

PetPAC is concerned because this bill will affect dog shows, cat shows, bird shows where a pet might be sold.
